                                              JUDGMENT

Learned Special Government Pleader appearing for the Revision Petitioner

sought for permission of this Court to withdraw the present revision and he has also

filed a Memo of Withdrawal of the Tax Case Revision dated 06.01.2023 to that effect.

2. In this regard, it is relevant to extract the Memo of Withdrawal of the Tax Case Revision here under:

''1. The above Tax Case Revision was filed by the Department against the orders passed in STA No.111/2008 without full set of papers viz. 2nd set, delay affidavit and petition, delay in representation, batta, dates and events, typed set, coding sheet, verified petition etc. and the same was returned by the Registry vide T.C.S.R.No.56969.

2. In the meantime, the orders passed in STA.No.111/2008 has been accepted by the Commissioner of Commercial Taxes/covered under litigation policy. Therefore, the Department has not represented the Tax Case Revision within the time stipulated by the Registry.

3. Now, we have filed memo of withdrawal of the above Tax Case Revision along with grounds of Tax Case Revision, delay affidavit and petition, delay in representation, memo of appearance and impugned order before the Registry for permission to withdraw.

Hence, it is prayed that this Hon'ble Court may be pleased to direct the Registry to number the above Tax Case Revision and thereby render justice.''

3. Recording the same, permission is granted to the learned Special

Government Pleader for the Revision Petitioner to withdraw the above Tax Case

Revision. Accordingly, the Tax Case Revision is dismissed as withdrawn. No costs.
