                     Prayer:- Second Appeal is filed under Section 100 of Code of Civil
                     Procedure Code,1908, to set aside the judgement and decree dated
                     03.09.2021 made in A.S.No.64 of 2016 on the file of the I
                     Additional Subordinate Court, Villupuram by confirming the
                     judgement and decree dated 28.04.2016 made in O.S.No.253 of
                     2013 on the file of the Principal District Munsif Court, Villupuram.

                                                       JUDGMENT

Today, the learned counsel appearing for the appellant has

filed an Affidavit of Undertaking dated 05.12.2023 signed by the

appellant/petitioner viz., Anbuselvam stating that he will vacate the

premises on or before 03.03.2024. This Affidavit of Undertaking is

taken on file.

2. This C.M.P.No.26000 of 2023 is disposed of on the

basis of this Affidavit of Undertaking which states in paragraph

no.4 as follows:

“4. I submit that I hereby undertake, clarify

and confirm that I will surely vacate the above

second appeal schedule shop premise and handover

the vacant possession of the same to the respondent

within three months from the date of this Affidavit

of Undertaking, ie., on or before 03.03.2024, if I

failed to comply the same or not vacating the

Second Appeal Schedule premise, this Hon'ble

Court may take necessary action against me.”

3. Accordingly, this C.M.P. stands disposed of in terms of

this Affidavit of Undertaking dated 05.12.2023 and consequently,

this second appeal in S.A.SR.No.126057 of 2023 stands closed. No

costs.
