PRAYER:- Civil Miscellaneous Second Appeal filed under Section 28 of
Hindu Marriage Act r/w Section 100 of C.P.C., against the judgment
made in H.M.C.M.A.No.4 of 2018 on the file of the IV Additional District
Judge, Madurai, dated 16.09.2020, confirming the order dated
19.07.2017 made in H.M.O.P.No.88 of 2014 on the file of the
I Additional Sub-Court(Melur Camp), Madurai.

JUDGMENT
This Civil Miscellaneous Second Appeal is filed against the
the judgment and decree made in H.M.C.M.A.No.4 of 2018 on the file of
the IV Additional District Judge, Madurai, dated 16.09.2020, confirming
the order, dated 19.07.2017 made in H.M.O.P.No.88 of 2014 on the file

of the I Additional Sub-Court(Melur Camp), Madurai.
2. When the matter is taken up for hearing today, both the
parties present along with their Advocates.
3. The matter was already referred to Mediation. Mediation
ended in success and mediation report, dated 06.11.2023, is filed and
the same is recorded.
4. The parties along with their counsel have filed a separate
memo today. As per the said memo, the parties, have settled the issue
on the following terms:
“(a) The appellant will give Rs.15,00,000/-
(Rupees Fifteen Lakhs) and 23 sovereigns of gold as
final one time settlement;
(b) Consent divorce petition will be filed for
dissolution of marriage.
As per the terms and settlement on
18.11.2023, the appellant has paid R.10,00,000/-

(Rupees Ten Lakhs Only) and 10 sovereigns of gold
jewels, to the respondent. The respondent also received
the same by consenting it.
The balance of Rs.5,00,000/-(Rupees Five
Lakhs Only) and 13 sovereigns will be handed over
before 17.05.2024 as agreed by the appellant.
Both the parties have accepted and agreed as
above.”
5. In view of the settlement reached between the parties, this
Civil Miscellaneous Second Appeal is disposed of on the above said
terms. The settlement agreement, dated 06.11.2023 and the memo,
dated 05.12.2023, shall form part of the record. No Costs.
