                                                          JUDGMENT

This appeal has been filed by the appellant/petitioner challenging

decreetal order dated 05.01.2023 made in I.A.No.01 of 2021 in

O.S.No.180 of 2010.

2.It is submitted by the learned counsel on either side that the

appeal ought to have filed before the Sub-Court, Krishnagiri.

3.In view of the above admitted position, the appellant is directed

to present the appeal before the Sub-Court, Krishnagiri. The Registry is

directed to return the papers of the appeal to the learned counsel for the

appellant.

4.With the above directions, this appeal is disposed of. No costs.

Consequently, connected miscellaneous appeal is closed.
