                     of 2009 on the file of the                  Additional District Munsif Court,
                     Ambasamudram.

                                                        JUDGMENT

This case has been listed before me for the 3rd time. On 24.03.2023,

when the matter was listed, the learned counsel for the appellant sought time

to argue the matter and on his request, the matter was adjourned to

31.03.2023 for arguments. On 31.03.2023, there was no representation on

the side of the appellant. Hence, this Court directed the Registry to list the

matter 'for dismissal' for today's hearing. Once again, there is no

representation on the side of the appellant. The learned counsel for the

respondent is present. It can now be inferred that the appellant is not

interested in prosecuting this Second Appeal. According, this Second

Appeal is dismissed for non-prosecution. No costs.
