Learned counsel for the appellant has given a letter to the Registry

dated 24.03.2023 requesting withdrawal of the appeal and the content of the

said letter is reproduced hereunder:

"Appellant filed the above appeal as against the judgment and decree dated 21.09.2016 passed in O.S. No. 118 of 2012 on the file of the Principal District Judge, Puducherry.

The above appeal has been settled between the parties. Appellant has given a letter dated 06.03.2023 requesting withdrawal of the appeal.

Hence, we hereby request you to post the appeal for withdrawal."

2. Hence, the first appeal stands dismissed as withdrawn. Parties

are entitled to refund of court-fee as permissible under the Rules. No costs.
