                                                         JUDGMENT

The parties have addressed the letter to the learned Counsel for the

appellant that they have settled the matter out of the Court. Based upon

the said letter, the learned Counsel for the appellant has also given a

letter to the Registry, seeking permission of the Court to withdraw the

Second Appeal. Therefore, this Second Appeal is dismissed as

withdrawn. No costs. Consequently, connected Miscellaneous Petition is

closed.
