JUDGMENT
(Made by PARESH UPADHYAY, J.)
Challenge in this appeal is made to the order dated 10.04.2013
recorded on W.P. No.7193 of 2011. This appeal is by the respondents/
State authorities.
2. Mr.V.Nanmaran, learned Government Advocate for the State
authorities has submitted that the basis of fixation of seniority as
accepted by the learned single Judge is against the policy of the State
and therefore that finding needs to be interfered with. It is submitted
that this appeal be entertained.
3. Having heard the learned Government Advocate for the
appellants and having considered the material on record, this Court
finds that learned single Judge on the basis of some earlier decisions of
this Court has granted relief to the writ petitioners.
3.1 The date of order of learned single Judge under challenge is
10.04.2013 and about a decade has passed by this time. We do not
consider it proper to interfere in the discretion exercised by learned
single Judge after about a decade.

3.2 We also find that there is a reference to the decision of this
Court in W.P. No.27036 of 2005 dated 13.04.2006 and it is informed
to the Court that against the said order, writ appeal was filed and it is
also dismissed at the relevant time.
4. In totality, we find that no interference is required. The writ
appeal is dismissed. No costs. Consequently, connected miscellaneous
petition is closed.
