                                                         JUDGMENT

The learned counsel appearing for the respondents 5 & 11,

who filed cross-objection, has stated that the sole appellant died in the

year 2006 itself and from the year 2006 to till date, no steps have been

taken to bring on record the legal heirs. Once the sole appellant died, if

steps have not taken within 90 days, the appeal will be dismissed as

abated automatically.

2. In this case, till date no steps have been taken and hence, this

appeal is dismissed as abated. No costs. Consequently, connected

miscellaneous petition is closed.
