This Civil Miscellaneous Appeal is directed against the

order dated 22.11.2019, passed by the Family Court in H.M.O.P.No.

334 of 2016.

2. By the impugned order, the appellant, who is the

husband, is asked to pay a sum of Rs.2,500/- per month each to the

wife and daughter towards maintenance. It is not in dispute that the

petitioner is working as a Software Engineer in Chennai. There is

absolutely no reason to dispute or quarrel as regards the financial

resources of the appellant as he is in employment as Software

Engineer. Though it is stated that the monthly income of the

appellant is only Rs.40,000/-, this Court is unable to accept the said

submission. Further, the direction of lower Court to pay Rs.5,000/-

per month in all, towards maintenance of his wife and minor child

cannot be faulted. Hence, this Court is unable to find any reason to

interfere with the order of the lower Court.

3. In view of the above, this Civil Miscellaneous Appeal is

dismissed. It is open to the appellant to show the copy of this

judgment, when the petition stated to have been filed by the wife

under Section 125 of the Code of Criminal Procedure, 1973 is

heard. No costs. Consequently, connected Miscellaneous Petition is

also dismissed.
