                          These appeals are filed as against the judgment and

                decree passed by the learned II Additional District Judge,

                Trichy, in A.S.Nos.56 & 47 of 1993, respectively, dated

                17.10.1994, confirming the judgment and decree passed by

                the learned Subordinate Judge, Trichy, in O.S.Nos.239 of

                1982 & 850 of 1984, respectively, dated 19.09.1991.



                          2.No representation for the appellant.



                          3.The notice ordered to the appellant was returned as

                'no such addressee'. Mr.VR.Shanmuganathan, learned Counsel,

                who undertook to file vakalath on behalf of the appellant

                in the last occasion reported 'no instructions'.



                          4.Mr.R.Devaraj,     learned   Counsel   appearing      for    the

                respondents 1 to 3 & 5 in C.M.P.Nos.15545, 15815 of 1995 is

                not having any instructions as to the whereabouts of the

                appellant.



                          5.In view of the above position, these second appeals

                stand             dismissed   for   non-prosecution.        No      costs.

                Consequently,           connected   miscellaneous     petitions        stand

                closed.
