                                                  JUDGMENT

This Civil Miscellaneous Second Appeal arises against the order and

decretal order passed in C.M.A.No.7 of 2007 dated 28.02.2008 by the I

Additional District Judge, Erode, ('ADJ' for short) confirming the order passed in

HMOP No.56 of 2004 dated 22.09.2006 passed by the Principal Sub Judge,

Erode.

2. Today, when the case is taken up for hearing, the learned counsel

appearing for the appellant filed a memo, dated 25.02.2022, reporting the death of

the sole respondent. The memo, dated 25.02.2022, filed by the appellant is

recorded.

3. Recording the memo filed by the learned counsel for the appellant, this
