Prayer: Civil Suit filed under Order VII Rule 1 of CPC read with Order IV
Rule 1 of Original Side Rules, praying to pass the following judgment and
decree against the defendants.
a) for a declaration, declaring the settlement deed
dated 26.06.2014 entered into between the plaintiff and
his brother late M.Srinivasan which was registered as
Document No.2705 of 2014 on the file of SRO, Anna
Nagar, as null and void, void ab initio, non-est in law and
the same is not binding upon the plaintiff.
b) for a declaration, declaring the settlement deed
dated 06.08.2014 entered into between the plaintiff and
his brother late Mr.Srinivasan which was registered as

Document No.3349 of 2014 on the file of SRO, Anna
Nagar, as null and void, void ab initio, non-est in law and
the same is not binding upon the plaintiff.
c) For a consequential declaration, declaring the oral
agreement reduced into Memorandum of Understanding
dated 31.05.2014 entered into between the plaintiff and
the father of the defendants as null and void, void ab
initio, non-est in law and the same is not binding upon
the plaintiff.
d) For a permanent injunction restraining the
defendants, their men, servants, agents, legal
representatives and assigns from in any way interfering
with the plaintiff's running of business styled as SRI
RADIO WAREHOUSE which has been carried on in the
suit schedule property.
e) For a permanent injunction restraining the
defendants, their men, servants, agents, legal
representatives and assigns from in any way alienating or
encumbering the suit schedule property to any third
parties
f) to pay costs of this suit.

JUDGMENT
This Civil Suit is filed for declarations, permanent injunctions and for
costs.
2. The learned counsel on either side has submitted that the matter
has been settled between the parties before the Mediation Centre and they
have entered into a compromise. Pursuant to the same, they have filed a
Joint Memo of Compromise dated 28.04.2022 which has been duly signed
by them and their respective counsel.
3. In view of the submissions made by the learned counsel on either
side and recording the Joint Memo of Compromise, this Suit stands
disposed of, in terms of the said Memorandum of Compromise, which shall
form part of the Decree. No costs. Court Fee is ordered to be refunded to
the plaintiff as per law. Consequently, connected original applications are
closed.
