                                  (a) Direct the defendant to pay a sum of Rs.1,39,61,271/- with interest

                     at the rate of 24% p.a from the date of plaint till the date of realization

                     within a particular time frame fixed by this Hon'ble Court.



                                  (b) For direction to the defendant to execute the sale deed in respect

                     of his shares in Villa 4 described as B schedule suit property.



                                  (c) For a permanent injunction restraining the defendant from causing

                     nuisance in the suit property either to the plaintiff or their representative.



                                  (d) For the cost of the suit.

                                                      JUDGMENT

Both parties submit that the dispute was settled pursuant to the

Memorandum of Compromise dated 05.04.2022. Accordingly,

C.S.(Comm.Div.) No.17 of 2022 is dismissed as settled out of Court. Since

such settlement was concluded before evidence was recorded, the plaintiff

shall be entitled to refund of full court fee. Consequently, O.A.No.55 of

2022 and A.No.463 of 2022 are closed.
