                                                       JUDGMENT

(Judgment of the Court delivered by S.VAIDYANATHAN,J.)

This Writ Appeal is directed against the order dated 10.04.2013 passed

by this Court in W.P.No.20947 of 2011.

2. Today, when the matter is taken up for hearing, it is represented

by the learned counsel appearing for the Respondent that, the

Respondent/Writ Petitioner is no more and that, he is unable to get the details

of the legal heirs of the deceased Respondent, to bring them on record.

3. In view of the said submissions, this Court interferes with the

order dated 10.04.2013 passed by the learned Single Judge in W.P.No.20947

of 2011 and accordingly, the same is set aside. In case, the legal heirs of the

deceased Respondent are interested in contesting, it is open to them to re-

open the case, by getting themselves substituted, and at that stage, the matter

will be heard on merits, if a prayer is requested.

In fine, the Writ Appeal is allowed. No costs. Consequently,

connected C.M.P.No.11270 of 2021 is closed.
