M.P.No.1 of 2013 is filed to condone the delay of 128 days in

preferring the above Writ Appeal against the order dated 14.02.2012

made in W.P.No.38813 of 2003.

2. It is stated by the learned counsel appearing for the appellant

that the sole respondent M.Harikrishnamaraju is no more and he is

unable to trace the legal heirs of the deceased respondent. He also

states that it will be difficult to recover the amount, even if he succeeds

in the writ appeal. Hence, he is not pressing the present writ appeal.

3. Accordingly, the petition filed for condonation of delay is

dismissed. Consequently, the Writ Appeal is rejected at the S.R. stage
