                      passed in A.S.No.113 of 2007 on the file of Additional District Court,
                      (Fast Track Court No.1), Erode District reversing the judgment and
                      decree dated 25.07.2007 made in O.S.No.13 of 2005 on the file of the
                      District Munsif cum Judicial Magistrate, Kodumudi, Erode District.

                                                        JUDGMENT

A joint memo of compromise has been filed today enclosing an

agreement dated 14.07.2021 entered into between the appellant and the

respondents 1 to 3 herein in the second appeal. The fourth respondent,

who is the brother of the appellant herein, had remained ex parte before

the appellate Court and hence, notice to him was dispensed with in the

second appeal. The dispute among the parties was with reference to a

entered into an Agreement dated 14.07.2021 with reference to settlement

which is reduced to writing.

2. In view of the settlement arrived at between the parties which is

reduced into writing, the Second Appeal is disposed of in terms of the

Agreement dated 14.07.2021, which shall form part of the decree.

Consequently, connected miscellaneous petition is closed. No order as to

costs.
