                                                   JUDGMENT

(Delivered by The Hon'ble Chief Justice)

It is submitted on behalf of the appellants that the appellants

have been constrained to offer the promoted post to the respondent

since contempt proceedings have been initiated. The appellants,

however, contend that the impugned order is contrary to law.

2. Since the promotion has been granted to the writ petitioner/

respondent, nothing remains of this appeal. The issue raised by the

appellant is left open for adjudication in an appropriate matter. For

such reason, the question decided by learned Single Bench may not be

treated as conclusive.

3. W.A.No.45 of 2021 is disposed of without any order as to

costs. Consequently, connected miscellaneous petition, C.M.P.No.498

of 2021, is also closed.
