                 PRAYER: This Second Appeal is filed under Section 100 of the Civil
                 Procedure Code, against the judgment and decree dated 08.10.1996 made
                 in A.S.No.9 of 1995 and I.A.No.164 of 1995 and I.A.No.190 of 1996 on the
                 file of Sub Court, Kuzhithurai confirming the judgment and decree dated
                 26.04.1994 and made in O.S.No.389 of 1985 on the file of the Principal
                 District Munsif of Kuzhithurai.

                                                   JUDGMENT

The learned counsel for the appellants Mrs.S.Ananthavalli that the

parties are not interested in prosecuting the matter and the appeal may be

appellants, this Second Appeal is dismissed for non-prosecution. No costs.

Consequently, connected miscellaneous petition is closed.
