                     PRAYER : Civil Suit filed under Order IV Rule 1 of the O.S. Rules
                     read with Order VII Rule 1 of C.P.C., prays for a Judgment and Decree
                     against the defendant:-
                           (a) directing the defendant to pay the plaintiff a sum of
                               Rs.1,04,64,830/- (Rupees One Crore Four Lakhs Sixty Four
                               Thousand Eight Hundred and Thirty Only) together with
                               future interest at 30% per annum from the date of plaint till
                               date of realisation;
                           (b) Appointing a Commissioner to seize the leased machinery
                               more fully described in the Schedule written hereunder and
                               directing him to deliver in to the plaintiff;

                           (c) to pay costs of the suit.

                                                   JUDGMENT

The learned counsel for the plaintiff seeks leave of the Court to withdraw

the suit.

2. Leave granted.

3. In view of the submission made by the learned counsel for the

plaintiff, this suit is dismissed as withdrawn. No costs.

4. Since the matter has been amicably settled between the parties out of

Court, Registry is directed to refund the Court fee as per law. The

plaintiff is also entitled to withdraw the amount of Rs.25,00,000/- in

Court deposit standing to the credit of the suit in terms of the order

passed by this Court in A.No.5629 of 2003 dated 19.01.2004.
