JUDGMENT
(Delivered by M.M.SUNDRESH, J.)
This writ appeal has been preferred against the order of the
learned single Judge, who rightly dismissed the writ petition after
holding that there is not only a default but the cancellation order has
not been put to challenge.
2.Though the learned counsel for the appellant tries to make
submission on merit, we are not inclined to entertain it as the ultimate
conclusion arrived at by the learned single Judge does not warrant
interference.
3.Taking note of the fact that the subject matter in the appeal is
against the dismissal of the writ petition filed by the appellant who
sought for handing over of the plot in tune with the memorandum, the
learned single Judge having noted that there appears to be a default
coupled with the cancellation order has not been challenged, no relief
can be granted. Now, it appears that the writ petition has been filed in
W.P.No.4169 of 2021 challenging the cancellation order.

4.In such view of the mater, we are closing the writ appeal with
the observation that the order of the learned single Judge will not
stand in the way of the issue raised in the writ petition in W.P.No.4169
of 2021 both on fact and law.
5.With the above observation, the writ appeal stands closed. No
costs. Consequently, connected miscellaneous petition is closed.
6.Registry is directed to post W.P.No.4169 of 2021 before the
learned single Judge dealing with the roster.
