this appeal has become infructuous in the light of the order passed

by one of us on 03.09.2019 in W.P. No.7081 of 2012.

2.In view of the submission made by the learned counsel

appearing for the appellant, this appeal stands dismissed as

infructuous. Consequently, M.P. No.1 of 2011 stands closed. No

costs.
