                                                                  ORDER

This is the first bail application filed by the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita , 2023/ 439 of Code of Criminal Procedure for grant of regular bail relating to FIR/Crime No.1079/2025 registered at Police Station - Rampur Baghelan, District - Satna (M.P.) for the offence punishable under Sections 8/20 and 29 of NDPS Act. The applicant is in custody since 06.03.2026.

2. Learned counsel for the applicant has submitted that as per

prosecution, it is alleged that on 08.12.2025, a raid was made in the house of co-accused Pankaj Singh and from his house 46.134 KG contraband Ganja was recovered and in his memorandum, it was disclosed that co-accused Anil Bagri has carried the Ganja on the instructions of the present applicant on 04.12.2025. Learned counsel for the applicant has further submitted that the applicant was arrested in a Crime No.380/2025 for offence under Sections

2 MCRC-12483-2026 8/20 of NDPS Act registered at Police Station - Nareni, District Banda and the bail order was passed by Hon'ble the Allahabad High Court in Bail Application No.2928/2026 on 16.02.2026, thus, the applicant was clearly in the custody and he was not present in on the spot on 04.12.2025, thus, the offence could not be committed by the applicant.

Learned counsel for the applicant has also submitted that the applicant has filed a complaint before the Judicial Magistrate First Class, Satna against the four Police Officers namely Ramayan Singh, Shivam Shukla, Ankesh Marmat and Prashant Parauha and being aggrieved with that the false case has been made against the present applicant on the basis of memorandum. Learned counsel for the applicant has further submitted that a complaint was made on 03.12.2021 to Superintendent of Police, Satna but no

inquiry was done after that Police in any case started implicating him on the basis of memorandum only. Co-accused Anil Bagri has been enlarged on bail and from the possession of the applicant, nothing has been recovered and the applicant did not supply any drug or contraband Ganja. Trial will take time to be concluded, hence, the applicant is entitled to be released on bail.

4. Learned counsel for the State has opposed the bail application and has submitted that the applicant has criminal record of three cases of the same nature, therefore, no case of bail is made out, hence, the applicant is not entitled to be released on bail.

5. Heard the parties and perused the case diary.

6. Looking to the factual aspects as well as the bail order of Hon'ble Allahabad High Court that the applicant was in custody and the applicant has

3 MCRC-12483-2026 been implicated in the case only on the basis of memorandum, coupled with the fact that trial will take time to be concluded, this Court deems it appropriate to enlarge the applicant on bail, therefore, without commenting anything on the merits of the case, this bail application is allowed.

It is directed that the applicant shall be released on bail on his furnishing personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the satisfaction of the trial Court concerned for his appearance before the said Court on all such dates as may be fixed by that Court in this regard during the pendency of trial.

8. It is further directed that the applicant shall comply with the provisions of Section 480(3) of BNSS.

9. Accordingly, Misc. Criminal Case stands disposed of. C.C. as per rules.
