ORDER
This petition has been filed for invoking inherent powers under Section 482 of the Cr.P.C./528 of BNSS, 2023 for quashment of RCT No. 7354 of 2019 registered on FIR dt. 10-10-2019 Crime No. 75/19 for offences punishable under Section 294, 323/34, 506 and 498A of IPC as well as Sections 4 of Dowry Protection Act 1961 by P. S. Mahila Thana District Jabalpur (M.P.) and subsequent proceedings arising therefrom.
2. Learned counsel for the applicants both the parties have amicably
settled their dispute and compromised the matter and both the parties have jointly filed the petition Section 13(b) of Hindu Marriage Act, before the Family court, Jabalpur. In pursuance of that application, divorce decree has been passed by the Family Court on 19-02-2026 on the basis of mutual consent, in which it is clearly mentioned that both the parties will withdraw the criminal cases filed against each other. 2 MCRC-8140-2026 No.7354/2019 is pending before the Judicial Magistrate First Class, Jabalpur for the offence punishable under Sections 294, 323/24, 506 and 498A of IPC and Section 4 of Dowry Prohibition Act.
3. Learned counsel for the parties placing reliance on the case of Jitendra Raghuvanshi and others vs. Babita Raghuwanshi and another passed in Criminal Appeal No.447/2013 vide judgment dated 15.03.2013 by the Supreme Court, Jagdish Channa and others vs. State of Haryana and another
-AIR 2008 SC 1968, Madan Mohan Abbot vs. State of Punjab - AIR 2008 SC 1969, Shiji vs. Radhika and another - (2011) 10 SCC 705, Narinder Singh and others vs. State of Punjab- (2014) 6 SCC 466 and Gian Singh vs. State of Punjab and others reported in (2012) 10 SCC 303 have submitted that criminal proceedings arising out of matrimonial disputes can be quashed
by the Court, if the Court is satisfied that the matter has been settled between the parties amicably.
4. Heard learned counsel for the parties and perused the record.
5. This Court is of the considered view that the aim and object of criminal law is not only to punish the offender, but also to maintain peace, tranquillity, and harmony in society. In the present case, the husband and wife, along with their family members, have amicably resolved their disputes, and their mutual objective is to settle their lives and live peacefully.
6. In view of the law laid down by the Hon'ble Supreme Court in Jitendra Raghuwanshi (supra) and Gian Singh (supra), this Court, in exercise of its inherent powers under Section 482 of the Code of Criminal Procedure, allows the present petition.

Accordingly, the criminal proceedings of RCT No. 7354/2019 registered on the basis of FIR vide Crime No. 75/19 for the offences punishable under Sections 294, 323/24, 506 and 498-A of IPC and Section 4 of Dowry Prohibition Act, 1961 at Police Station Mahila Thana District - Jabalpur and all consequential proceedings arising therefrom are hereby quashed on the basis of the compromise entered into between the parties.
8. Accordingly, petition stands allowed/disposed off.
