                              1]    They are heard. Perused the case-diary.
                              2]     This is the first application filed by the applicant Anandilal under

Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023/Section 438 of Criminal Procedure Code, 1973 for grant of anticipatory bail as he is apprehending his arrest in connection with Crime No.536/2025 registered at Police Station Sanwer, District Indore for the offence punishable under Sections 420, 467, 468, 419, 471, 120-B and 34 of the IPC. 3] The allegation against the applicant is of fraud and impersonation, as it is alleged that he along with other accused persons obtained a total sum of Rs.3,72,59,652/- from the complainant, on the pretext of selling the land in the name of Pramod Kumawat, and the documents of Pramod Kumawat were also shown to the complainant, however, the documents were forged, and the sale deed was also executed by impersonating Pramod Kumawat by

4] Counsel for the applicant, at the outset, has submitted that the total amount which he has allegedly received in the transaction is Rs.50,00,000/-, and he is ready to deposit the same, however, some breathing time may be given.

5] Counsel for the objector, as also the State, on the other hand, have opposed the prayer.

6] Having considered the rival submissions, on perusal of the case- diary, and taking into account the fact that the applicant is ready to deposit the amount, and apparently, the interest of the complainant would also be to secure the amount first. In view of the same, in order to secure the amount of fraud, this Court is inclined to allow the present application, subject to depositing a sum of Rs.50 Lakhs by the applicant in the Trial Court. 7] Accordingly, without reflecting anything on the merits of the case, the application filed under Section 482 of B.N.S.S./438 of Cr.P.C. on behalf of the applicant is hereby allowed, subject to depositing a sum of Rs.50,00,000/-(Rupees Fifty Lakhs only) by the applicant or any other person on his behalf in the manner as prescribed herein, and the said amount shall be subject to the final outcome of the case by the trial Court.

8] Thus, it is directed that the applicant shall deposit a sum of Rs.10,00,000/- (Rupees Ten Lakhs) before his release, i.e. at the time of furnishing the bail bond in a fixed deposit in a nationalized bank and producing the receipt/certificate of the same before the concerned trial Court and the remaining amount of Rs.40,00,000/-(Rupees Forty Lakhs) to be deposited by the applicant in four equal installments of Rs.10,00,000/- each

3 MCRC-56609-2025 within a further period of four months from the date of his release, in a fixed deposit in a nationalized bank and producing the receipt/certificate of the same before the concerned trial Court and the said amount shall be subject to the final outcome of the case by the trial Court. The installment shall

commence after one month from the date of release and shall be paid by 5th of every month. The deposit receipt/certificate so produced by the applicant shall be endorsed by the learned Judge of the lower Court to be 'furnished towards the bail of the applicant and shall be subject to the final decision of the case by the trial Court'.

9] It is directed that in the event of arrest, applicant shall be released on bail, upon his executing a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) and furnishing one solvent surety in the like amount to the satisfaction of the Arresting Officer (Investigating Officer). The applicant shall make himself available for interrogation by a Police Officer, as and when required. He shall further abide by the other conditions enumerated in Sub Section (2) of Section 438 of the Code of Criminal Procedure, 1973. 10] Accordingly, M.Cr.C. stands allowed and disposed of.
