                                                                     ORDER

Today, due to call of High Court Bar Association, Gwalior Advocates are abstaining from Court work.

The applicant has filed this first application under Section 483 of the BNSS for grant of temporary/interim bail.

The applicant was arrested on 09.02.2026 by Police Station Padav, District Gwalior, in connection with Crime No.27/2026 registered for offences punishable under Sections 25(1-B)(A) of Arms Act.

As per the case diary, acting on information received from an informant, the

police apprehended one Arpit Arora alias Aryan, aged 19 years, resident of Gwalior, near Laxmibai Samadhi. Upon search, he was found in possession of an illegal country-made pistol. Since the accused failed to produce any valid license or authorization for carrying the said firearm, the weapon was seized in accordance with law. Consequently, a case was registered against him under the relevant provisions of the Arms Act.

In the bail application it is submitted that the applicant is innocent and has

2 MCRC-9202-2026 been falsely implicated in the present case. The applicant has no direct or indirect involvement whatsoever in the alleged offence. The applicant is a young student pursuing his First Year BBA and has been leading a peaceful life. He has no previous criminal history. Prolonged judicial custody at such a formative stage of life is likely to have a serious adverse impact on his mental well-being and overall development. The continued incarceration of the applicant is severely affecting his education. The applicant is in judicial custody since 09.02.2026 and the trial is likely to take considerable time to conclude. The applicant is permanent resident of District Gwalior and there is no likelihood of his absconding or tampering with the prosecution evidence, and he is willing to abide by any condition that may be imposed by this Court. On these grounds, a prayer is made to enlarge the applicant on bail.

Considering the averments made in the bail application and perusing the case diary, coupled with the fact that the trial is not likely to conclude in near future and prolonged pre- trial detention being an anathema to the concept of liberty, this Court is inclined to extend the benefit of bail to the applicant.

Accordingly, without expressing any opinion on the merits of the case, the application is allowed. It is directed that the applicant be released on bail upon furnishing a personal bond in the sum of ₹50,000/- (Rupees Fifty Thousand only), with one solvent surety in the like amount, to the satisfaction of the Trial Court/Committal Court, for securing his appearance on the dates fixed by the concerned Court.

This order will remain operative subject to compliance of the following conditions by the applicant:-

1. The applicant will comply with all the terms and conditions of the bond executed by him;

2. The applicant will cooperate in the investigation/trial, as the case may be;

3. The applicant will not indulge themselves in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to the Police Officer, as the case may be;

4 . The applicant shall not commit any other offence during pendency of the trial, failing which this bail order shall stand cancelled automatically, without further reference to the Bench;

5. The applicant will not seek unnecessary adjournments during the trial; and

6. The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.

The Court expresses its appreciation for the able, efficient, and commendable assistance rendered by Shri Jai Prakash Bhargava on behalf of the Advocate General's Office.
