                                                                   ORDER

Heard finally with the consent of both the parties.

1. This instant writ petition has been filed by the petitioners under Article 226 of the Constitution of India, seeking police protection to the petitioners who are major and have solemnized the marriage on 26.02.2026 as per Hindu Rites and Customs. The petitioners have also placed on record the marriage certificate issued by Arya Samaj Sanchar Nagar, Indore (MP)

and from the said certificate, it appears that both the petitioners are major.

2. It is stated that the family members of petitioner No.1 are against their marriage and have started threatening the petitioners for their life. If the petitioners are major and have entered into the marriage voluntarily, then they should not be harassed by anyone just because they have an objection with their marriage. In order to avoid any harassment, the petitioners are

2 WP-7926-2026 certainly entitled for police protection.

3. The same has already been held by the Apex Court in the case of Lata Singh Vs. State of Uttar Pradesh & Another reported in AIR 2006 SC 2522.

4. In view of the above, the petitioners are directed to approach the Commissioner of Police, Indore (MP) along with their documents relating to age proof and marriage and record their statements and also inform the name of the persons/parties who are threatening them. If the petitioners cannot approach the Commissioner of Police for any reason and in case of an emergency, then they are permitted to approach the nearest Police Station to record their statements. If the Commissioner of Police/Station House Officer (SHO) of concerned police station finds that there is a threat to the life of the

petitioners, then he shall immediately take action in accordance with the direction given by the Hon'ble Apex Court in the case of Shakti Vahini vs. Union of India reported in (2018) 7 SCC 192 , which shall be subject to the verification of the age proof and the marriage certificate produced by the petitioners. The petitioners shall approach before the concerned Commissioner of Police/SP/SHO and shall produce the documents in respect of their age and marriage certificate and the authority concerned shall further verify the authenticity of those documents and if finds fit then police protection may be granted.

5. Needless to mention that the authenticity of the documents annexed with the petition is not examined by this Court under the writ jurisdiction under Article 226 of the Constitution of India. The authorities are

3 WP-7926-2026 free to examine the authenticity of the documents so annexed i.e the age proof and the solemnization of the marriage. If it is found by the authorities that the petitioners are adults, statements may be recorded accordingly regarding their wish to reside together and accordingly protection may be granted, if the statements are positive that they want to reside together and they are adults.

6. With the aforesaid direction, the present writ petition stands disposed of.

7. It is directed that a copy of this order be supplied to the Advocate General and he is directed to communicate the order to the Commissioner of Police, Indore (MP) for prompt compliance of the order.
