ORDER
This is second application filed by the applicant under Section 483 of the BNSS for grant of regular bail. The applicant has been arrested in connection with Crime No.283/2025 registered at Police Station Shamshabad, District Vidisha (M.P.) for the offence under Sections 80 of BNS. First bail application was dismissed as withdrawn with liberty to renew the prayer after examination of material prosecution witnesses vide order dated 26.11.2025 passed in MCRC No.48601/2025 by this Court.
2. As per the prosecution story, the allegation against the present applicant along with co-accused subjected the deceased with cruelty for demand of dowry, due to which she died by hanging herself, Therefore, the aforesaid crime was registered.
3. Learned counsel for the the applicant submits that applicant has falsely been implicated in the present case. He is in custody since

2 MCRC-8069-2026 12.08.2025. The investigation is complete and charge sheet has been filed. There is no specific role or act has been alleged against the present applicant and only omnibus allegations have been levelled against him. It is further argued that statements of family members of deceased including parents have been examined and they have not stated anything against the present applicant and turned hostile. There is no criminal antecedents against the present applicant. Applicant is a permanent resident of District - Vidisha and there is no possibility of his absconsion or tampering with the prosecution evidence, if released on bail. Under these grounds, counsel for applicant prayed for grant of bail to the applicant.
4 . Per contra, Dy. Government Advocate for the State vehemently opposed the bail application and prayed for its rejection.
5. Heard learned counsel for the rival parties and perused the case diary.
6. Considering the above submissions made by the counsel for the parties and facts and circumstances of the case, but without expressing any opinion on merits of the case, this application is allowed and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) along with one solvent surety in the like amount to the satisfaction of the trial Court/Committal Court.
7. This order will remain operative subject to compliance of the following conditions by the applicant:-
i) The applicant will comply with all the terms and conditions of the

ii) The applicant will cooperate in the investigation /trial, as the case may be;
iii) The applicant will not indulge himself /herself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such acts to the Court or to the Police Officer, as the case may be;
iv) The applicant will not commit any other offence or will not repeat the offence in future.
v) The applicant will not seek unnecessary adjournments during the trial; and
vi) The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.
8. The application stands allowed and disposed of. E- copy of this order be sent to the trial Court concerned for compliance.
