                                                                         ORDER

The present petition has been filed seeking the following reliefs :-

"1. Issue a mandamus writ, directing the M.P. Board of Secondary Education to accept the examination forms and some enrollment of the students of the petitioner's institution, Maa Narmada Devi Memorial School, Gopalpur, District Sehore (M.P.) and permit them to appear that examination the High School Board Examination commencing from 17.02.2026;

2. Direct the respondents to treat the concerned students as regular candidates and not as private candidates;

3. Pass any other order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice."

It is the case of the petitioner that the school is functioning since the year 2018. 51 students are studying in the petitioner/School and are eligible to appear in the Board Examinations which commence from 17.02.2026. It is pointed out that due to unavoidable circumstances, the school could not submit the examination forms of 51 students and some students' enrolment form within the prescribed time. He has drawn attention of this Court to the

2 WP-5995-2026 document Annexure P-1 which is a letter issued from the Board of Secondary Education to the Principal of the school pointing out the fact that they are required to deposit the examination fees of Rs.1200/- along with a late fees of Rs.15000/- per student, totaling to Rs.16,200/- along with relevant documents in Bank Account No.02830100006001 IFSC Code UCBA0000283 prior to 10.02.2026 as the exams commence from 17.02.2026.

Learned counsel for the petitioner submits that the petitioner/school is ready to submit all the relevant documents along with the examination fees and late fees to the respondent No.2/Board but due to fact that the portal is closed, they are not able to submit the same. He further submits on instructions that the school will be bearing the late fees of all the students

and will only charge the examination fees from the students. He submits that a direction be given to the Board authorities to open the portal for a day to enable them to submit the relevant documents along with the examination fees.

Counsel appearing for the respondent No.2 on advance notice on instructions has submitted that as the exams are required to commence from 17.02.2026, coupled with the fact that there are 51 students who are imparting education for High School in the petitioner/institution, in the interest of justice, they are ready to open the portal for deposition of the relevant documents along with examination fees and late fees. It is submitted that the answer booklets for the students of different schools have already been dispatched, therefore, the petitioner may be directed to complete all the

3 WP-5995-2026 formalities including the examination fees, late fees and submit the relevant documents by tomorrow positively, to enable them to permit the students to appear in the Board Examination which is commencing from 17.02.2026. His statement is placed on record.

Under these circumstances, this petition is disposed off directing the respondent No.2/Board to open the portal for a day to enable the petitioner/school to deposit the relevant documents along with the examination fees and late fees i.e. Rs.16,200/- per student. The fees and documents are required to be deposited for all 51 students. On submission of all the relevant documents and examination fees along with late fees the respondent No.2/Board is directed to ensure that the answer booklets along with admit cards are issued to the petitioner/school to enable them to make all possible arrangements to facilitate the students to appear in the examinations.

The school authorities have undertaken that they will only charge the examination fees from the students and deposit the late fees on their own because they are solely responsible for not completing the formalities within time.

In view of the undertaking as well as the consensus given by the respondent No.2/Board, this petition is disposed off on the aforesaid terms.

It is made clear that petitioner/school should make all possible arrangements and should ensure that all 51 students are appearing in the High School Examination of M.P. Board of Secondary Education which is to

commence from 17.02.2026, failing which this Court will be constrained to

4 WP-5995-2026 pass any adverse orders against the petitioner/school, if the academic career of any of the students suffers for the fault of the school.

Let the compliance report be placed before this Court in the next week. Accordingly, the petition is disposed off.
