                                                                ORDER

This is the first application filed by the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail relating to FIR/Crime No.11/2026 registered at Police Station Shyampur, District Sehore, for the offence punishable under Sections 80(2), 85 of the Bharatiya Nyaya Sanhita, 2023 and Section 3/4 of the Dowry Prohibition Act. The applicants are in jail since 17.01.2026.

2. Learned counsel for the applicants has submitted that the applicants are the mother and sister of Santosh, with whom the victim was having love affair.

Later on, Santosh and victim entered into marriage, but there was no demand of dowry. At the time of marriage, both the husband and wife were working at Indore, but after marriage, they shifted to Village Khajuri Kala, District Sehore and started residing there. The victim's father-in-law had provided a separate residence to them. Subsequently, the victim committed suicide, and nine days after her death, the husband also passed away. It is contended that, due to the love marriage, the family members of the deceased were angry and, therefore, they

2 MCRC-5327-2026 have falsely implicated the entire family in the present case. The applicants are innocent and have falsely been implicated in the case. Trial will take time to be concluded, hence, the applicants be enlarged on bail.

3. Learned counsel for the respondent/State has opposed the bail application and has submitted that marriage was solemnized on 24.05.2024 whereas the victim committed suicide on 22.12.2025. As per the statements of the family members of the deceased, it is clear that the applicants were residing with the deceased and harassing her. Applicant No.1 was harassing the deceased stating that if she left their house, then they would arrange their son's remarriage with another girl by giving Rs.3,50,000/-. In these circumstances, the deceased has committed suicide. According to him, looking to the nature of crime, no case of bail is made out in favour of the applicants.

4. Heard the parties and perused the case diary.

5. From the material available on record, it is clear that the merg intimation was made by the victim's brother namely Rahul Raghuwanshi on 22.12.2025 at Police Station Shyamnagar. As per that, the victim's husband was called to the police station and instructed to bring the victim to police station so that her brother could take her to her paternal house, as the husband of the deceased was misbehaving in an unruly manner with the brother and other family members, when they went to take the victim. When the victim's husband returned to carry the victim to the police station, she was found dead. In the merg intimation, nowhere it has been mentioned that the husband of the deceased and other family members were harassing her. From the statements of prosecution witnesses, it is also clear that the deceased and applicant were in love affair and thereafter, they entered into love marriage. 3 MCRC-5327-2026 that the other family members of the husband were residing separate from the deceased and her husband.

6. Looking to the aforesaid factual aspects of the case, this Court is inclined to enlarge the applicants on bail. Thus, without commenting anything on the merits of the case, the application is allowed.

It is directed that applicants shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) each with one solvent surety of the like amount each to the satisfaction of the trial Court concerned for their appearance before the said Court on all such dates as may be fixed by that Court in this regard during pendency of trial.

8. It is further directed that the applicants shall comply with the provisions of Section 480(3) of BNSS.

9. Accordingly, Misc. Criminal Case stands disposed of. Certified copy as per rules.
