ORDER
The applicant has filed this second bail application u/S.483 of BNSS for grant of bail. Applicant has been arrested on 21.01.2026 by Police Station- Anandpur, District- Vidisha in connection with Crime No.15/2026 for the offence punishable under Sections 108 of BNS.
2. The allegation against the present applicant is that due to harassment caused by him, the deceased committed suicide.
3. Learned counsel for the applicant submits that the applicant has
been falsely implicated in the case. He has not committed any offence. The applicant is suffering confinement since 21.01.2026. It is further submitted that even if the entire prosecution story is believed to be true, the ingredients of Section 108 of BNS do not attract in the case. It is further argued that the allegation does not come within the purview of instigation for committing suicide. Trial will take time for its conclusion. The applicant is permanent

2 MCRC-13162-2026 resident of District Ashoknagar and there is no likelihood of his absconsion or tampering with the prosecution evidence. Investigation is almost over. Applicant does not bear any criminal record. Applicant undertakes to cooperate in trial as well as investigation and would make himself available as and when required. He would abide by the terms and conditions as imposed by this Court. It is further submitted that co-accused persons have already been granted bail by the Coordinate Bench of this Court. Under these grounds and o the ground of parity, counsel for the applicant prayed for bail.
4. Learned PP for the respondent/State opposed the prayer and prayed for dismissal of this application.
5. Considering the overall facts and circumstances of the case, nature of allegations and coupled with the fact that the trial is not likely to conclude
in near future and prolonged pretrial detention being an anathema to the concept of liberty, this Court is inclined to extend the benefit of bail to the applicant.
6. Accordingly, without expressing any opinion on merits of the case, this application is allowed and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount to the satisfaction of the trial Court/committal Court for his appearance on the dates given by the concerned Court.
7. This order will remain operative subject to compliance of the following conditions by the applicant:-
i. The applicant will comply with all the terms and conditions of the

ii. The applicant will cooperate in the investigation/trial, as the case may be;
iii. The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to the Police Officer, as the case may be;
iv. The applicant shall not involve in any criminal activities in future and shall not commit an offence similar to the offence of which he is accused;
v. The applicant will not seek unnecessary adjournments during the trial;
vi. The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.
8. Application stands allowed and disposed of. Copy of this order be sent to the trial Court concerned for compliance. Certified copy as per rules.
