ORDER
This is the first bail application filed by the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) seeking grant of bail.
The applicant has been arrested on 24.10.2025 in connection with Crime No.254/2022 registered at Police Station Bamori, District Guna for the offences punishable under Sections 394/34, 392, 397, 120-B of
IPC.
According to the prosecution, on 29.11.2022, at approximately 6:00 PM, the complainant, along with Nazir Khan and Devendra Jatav, was traveling towards Guna in a goods vehicle (Chhota Hathi) after collecting goods. When they reached near village Amrod, they were stopped on the road by four unknown persons, who had covered their

2 MCRC-14414-2026 faces and one of the assailants pressed a knife against the complainant's waist, and another pointed a country-made pistol (katta) at the temple of Devendra Jatav, who was in the driver's seat. Another assailant sprayed a substance (similar to chili spray) into the eyes of the complainant and Nazir Khan, causing intense burning and irritation in their eyes. Thereafter, they snatched a black-colored bag containing approximately Rs.62,000/- from the complainant and fled from the scene towards Bamori. Based on the above complaint, instant FIR was registered against unknown persons.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the case. He is in custody since 24.10.2025
and the trial will take time for its conclusion. The co-accused Ranu@Shahid has already been granted benefit of bail by the co- ordinate Bench of this Court vide order dated 16.10.2025 passed in M.Cr.C. No.46840/2025, therefore, applicant seeks parity also. Offence is triable by JMFC. The applicant is a permanent resident of Baran, District Baran (Rajasthan) and there is no likelihood of his absconsion or tampering with the prosecution evidence. He is ready to abide by the terms and conditions as may be imposed. With the aforesaid submissions, prayer for grant of bail is made.
Learned counsel for the State has vehemently opposed the application and prayed for its rejection.

Considering the overall facts and circumstances of the case coupled with the fact that the trial is not likely to conclude in near future and prolonged pre- trial detention being an anathema to the concept of liberty and on the ground of parity also, this Court is inclined to extend the benefit of bail to the applicant.
Accordingly, without expressing any opinion on merits of the case, this application is allowed and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with two local sureties of the like amount to the satisfaction of the trial Court/committal Court for his appearance on the dates given by the concerned Court.
This order will remain operative subject to compliance of the following conditions by the applicant:-
1. The applicant will comply with all the terms and conditions of the bond executed by him;
2. The applicant will cooperate in the investigation/trial, as the case may be;
3. The applicant will not indulge themselves in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Police Officer, as the case may be;
4 . The applicant shall not commit any other offence during

4 MCRC-14414-2026 pendency of the trial, failing which this bail order shall stand cancelled automatically, without further reference to the Bench;
5. The applicant will not seek unnecessary adjournments during the trial; and
6. The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.
