                                                                ORDER

This is the first application filed by the applicant u/S. 483 of BNSS for grant of bail relating to Crime No.317/2025 registered at Police Station - Kotwali District - Sheopur (M.P.) for the offence under Sections 318(4) and 112(1) of BNS.

2. The brief story of the case is that the complainant lodged a report stating that he deals in the kiosk shop. On 18.12.2025. the co-accused came to his shop and in exchange of cash, got some money deposited from a

different UPI ID ( that does not belong to him) into the account of the complainant/his co-worker and took cash from the shop. On the next day i.e. 19.12.2025, the received a mail from the Bank stating that his account has been held and no transaction can be made from it. The hold of the account was due to deposition of unauthorized money and upon the complaint of cyber crime. Accordingly, offence has been registered.

3. Learned counsel for the applicant submitted that applicant is innocent and has been falsely implicated. He is under custody since 26.11.2025. He further submitted that the applicant has not committed any crime and there is no evidence against him. It is further argued that the co- accused-Pawan Meena,, has already been enlarged on bail by this Court vide order dated 09.03.2026 passed in M.Cr.C. No.10607/2026 and co-accused Ankush Meena has also been enlarged on bail by this court vide order dated13.03.2026 passed in M.Cr.C. No. 9513/2026, therefore, the present applicant seek parity also. He does not bear any criminal or tainted background. He is a permanent resident of District Sheopur (M.P.) and there is no chance of his absconsion and tampering with the prosecution evidence.

He is ready and willing to abide by any terms or condition as may be imposed by this Court and is ready to make himself available as and well required. Hence, is prayed that the applicant be enlarged on bail.

4. Counsel for the respondent/State has opposed the bail application and prayed for its rejection.

5. Heard learned counsel for the rival parties and perused the case diary and also perused the charge-sheet.

6. From perusal of the charge-sheet and considering the above submissions made by the counsel for the parties, looking to the facts and circumstances of the case and the nature of offence and also on the ground of parity, but without expressing any opinion on merits of the case, this application is allowed and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty

3 MCRC-14423-2026 Thousand only) along with one solvent surety in the like amount to the satisfaction of the Trial Court.

7. This order will remain operative subject to compliance of the following conditions by the applicant:-

i) The applicant will comply with all the terms and conditions of the bond executed by him/her;

ii) The applicant will cooperate in the investigation /trial, as the case may be;

iii) The applicant will not indulge himself/herself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such acts to the Court or to the Police Officer, as the case may be;

iv) The applicant will not commit any other offence or will not repeat the offence in future.

vi) The applicant will not seek unnecessary adjournments during the trial; and

vii) The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.

8. Application is allowed and disposed of.

9. E- copy of this order be sent to the trial Court concerned for compliance.
