Appellant - Pintu Singh, is aggrieved of the judgment dated 28.6.2023, passed by the learned Special Judge, SC/ST (Prevention of Atrocities) Act, Anuppur (M.P.), in Special Case No.40/2019, whereby, appellant has been convicted and sentenced as under :-

Learned counsel for the appellant submits that this is first application for suspension of sentence on behalf of appellant-Pintu Singh. He is

innocent. His name is not mentioned in the FIR. He has been made as an accused on the basis of memorandum of Shani alias Sunil as contained in Ex.P/23. Recovery of sword is shown from the house of Shahjad and not from the house of the present appellant Pintu Singh. There are no blood stains on the said sword. As per the postmortem doctor PW/21 Dr. Rajkumar, there were no injuries caused with a sword and in cases of death cause is shown as strangulation/throttling. It is, thus, submitted that appellant has been falsely implicated. Even, so-called eye witnesses are PW/3 Nanda Yadav, PW/4 Rani Dwivedi, PW/5 Pappu Kahar, PW/7 Sampatiya Bai, PW/11 Gudiya Rotel, PW/15 Roshni Kahar have not identified the present appellant. There are good chances of success of this appeal. Hence, prayer is

made to suspend the remaining jail sentence of the appellant and release him on bail.

Shri Manas Mani Verma, learned Public Prosecutor adopts objections filed on behalf of co-accused persons. He submits that it is a gruesome murder of two persons, namely, Phool Singh and Murlimanohar Soni @ Mukku, therefore, no indulgence is required to be called for. He opposes the prayer of the appellant.

After hearing learned counsel for the parties and going through the record, this Court is of the opinion that it is a fit case to suspend the remaining part of the jail sentence of the present appellant and to release him on bail.

Taking these facts into consideration and other circumstances, it is

3 CRA-9448-2023 directed that on depositing the fine amount, if not already deposited and on furnishing a personal bond to the tune of Rs.30,000/- (Rupees Thirty Thousand Only), with two solvent sureties in the like amount to the satisfaction of the Trial Court for his appearance before the Trial Court on 11.11.2025 and such other dates as may be fixed by the Trial Court, the execution of remaining part of the jail sentence imposed upon Appellant - Pintu Singh shall remain suspended and he shall be released on bail till final disposal of this appeal.
