Petitioner is aggrieved by order dated 10.7.2025 (Annexure P/1) passed by Tehsildar, Tehsil Chinor, District Gwalior, whereby direction has been given for auction of land appurtenant to temple has been declared to be

auctioned.

It is the grievance of petitioner that the temple is private in nature and State has no authority to auction the said land belonging to temple. He relied upon Mst. Kanchanaiya vs. Shiv Ram and others, AIR 1992 SC 1239 and the judgment passed by this Court in the case of Radheshyam Sharma vs. State of M.P. reported in (2022) 3 MPLJ 229 .

Issue notice to the respondents on payment of process fee within seven days by RAD mode, returnable within four weeks.

Till next date of hearing, effect and operation of order dated 10.7.2025

passed by Tehsildar, Tehsil Chinor, District Gwalior regarding auction of land in question shall remain stayed.
