                                 Heard on the question of admission.
                                 On payment of process fee within seven working days, notices be
                           issued to the respondents, returnable within four weeks. In case of failure to

deposit the process fee, this order shall stands vacated automatically without further reference to this Court.

Also heard on I.A. No.6443/2025 an application for stay. It is submitted that the present petition has been filed under Article 227 of the Constitution of India being aggrieved by the order dated 14.05.2025 passed by Additional Commission, Ujjain in Revision No.7/2019-2020 wherein the learned Commissioner has passed the order regarding removal of encroachment while the revision was filed by petitioner challenging the interlocutory order dated 29.03.2019 passed on an

application under Order 13 Rule 10 of CPC by the Collector in case No22/B- 212/2015-2016. It is submitted that such findings cannot be passed in revision by learned Commissioner. He has also relied upon a Judgment of this Court in the case of Vedvrat Sharma and Others vs. State of M.P. and Others [2020 (4) MPLJ 420].

Counsel for the State has however prays for time to seek instruction in

2 MP-3550-2025 the matter.

In view of the aforesaid, application is allowed. The effect and operations of the impugned order dated 14.05.2025 passed by Additional Commission, Ujjain in Revision No.7/2019-2020 shall remain stayed and the parties are directed to maintain the status quo till the final disposal of this petition.

List the matter alongwith the service report. Certified copy, as per rules.
