                                                                  ORDER

This petition has been filed for invoking inherent powers under Section 482 of the Cr.P.C. for quashment of the Criminal case arising out of RCT No. 2240 of 2022( State of M.P. Vs. Iqbal Singh Chhabda & Others) registered on FIR No. 120/22 for offences punishable under Section 498A and 34 of IPC as well as Sections 3/4 of Dowry Protection Act 1961 by P. S. Gorakhpur, District Jabalpur (M.P.).

2. Learned counsel for the applicants has submitted that trial is

pending before the Judicial Magistrate First Class, Jabalpur under Sections 498-A/34 of IPC and under Sections 3/4 of Dowry Prohibition Act, 1961 and case is at the stage of prosecution evidence. Meanwhile, both the parties have amicably settled their dispute and compromised the matter. It is further submitted that matter has been sent to Registrar (J) for verification of compromise and report has been received that both the parties have amicably

2 MCRC-55321-2024 settled their dispute.

3. Learned counsel for the parties placing reliance on the case of Jitendra Raghuvanshi and others vs. Babita Raghuwanshi and another passed in Criminal Appeal No.447/2013 vide judgment dated 15.03.2013 by the Supreme Court, Jagdish Channa and others vs. State of Haryana and another

-AIR 2008 SC 1968, Madan Mohan Abbot vs. State of Punjab - AIR 2008 SC 1969, Shiji vs. Radhika and another - (2011) 10 SCC 705, Narinder Singh and others vs. State of Punjab- (2014) 6 SCC 466 and Gian Singh vs. State of Punjab and others reported in (2012) 10 SCC 303 have submitted that criminal proceedings arising out of matrimonial disputes can be quashed by the Court, if the Court is satisfied that the matter has been settled between the parties amicably.

4. Heard learned counsel for the parties and perused the record.

5. This Court is of the considered view that the aim and object of criminal law is not only to punish the offender, but also to maintain peace, tranquillity, and harmony in society. In the present case, the husband and wife, along with their family members, have amicably resolved their disputes, and their mutual objective is to settle their lives and live peacefully.

6. In view of the law laid down by the Hon'ble Supreme Court in Jitendra Raghuwanshi (supra) and Gian Singh (supra), this Court, in exercise of its inherent powers under Section 482 of the Code of Criminal Procedure, allows the present petition.

7. Accordingly, the criminal proceedings arising out of RCT No. 2240/2022, registered on the basis of FIR No. 120/22 offences punishable

3 MCRC-55321-2024 under Section 498-A/34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961 at Police Station Gorakhpur District -Jabalpur and all consequential proceedings arising therefrom are hereby quashed on the basis of the compromise entered into between the parties.

8. Accordingly, petition stands allowed/disposed off.
