                                                                 ORDER

Learned counsel for the applicant submits that the applicant has cooperated in the investigation in compliance with the notice under Section 35(3) of BNS, 2023. However, the applicant apprehend the arrest at the time of filing of challan as the offence punishable under Sections 74 and 75 are triable by Court of Session, therefore, applicant may be extended benefit of anticipatory bail.

The apprehension of the applicant has no legal foundation, rather, it appears to be fear more than an apprehension.

Learned counsel for the applicant after arguing for a while, prays for withdrawal of this petition filed under Section Section 482 of BNS, 2023 for grant of anticipatory bail and requests for direction to the trial Court to comply with the judgment of Apex Court passed in the case of Amanpreet

The application is dismissed as withdrawn. However, the trial Court is expected to comply with the guidelines laid down in cases of Arnesh Kumar Vs. State of Bihar (2014) 8 SCC 273, Satender Kumar Antil Vs. Central Bureau of investigation (2022) 10 SCC 51, Siddharth vs. State of Uttar Pradesh & Another, reported in (2022) 1 SCC 676 and Amanpreet Singh Vs. CBI 2022 (13) SCC 764 [para 10, 11 & 12 of the judgment specifically] while considering the bail petition of the applicant.
