Heard on I.A. No.25311/2024, third repeat application under Section 389 of Cr.P.C. for suspension of sentence filed on behalf of sole appellant Ravindra Darji.

This Criminal Appeal has been preferred under Section 374 of the Cr.P.C. against the judgment of conviction and order of sentence dated 10.08.2023 passed by Second Additional Sessions Judge, District Bhind (M.P.) in S.T.No.100/2019, whereby the appellant has been convicted under Section 302/34 of IPC and sentenced to undergo life imprisonment with fine of Rs.2,000/- with default stipulations.

3. It is the submission of learned counsel for the appellant that trial Court erred in convicting the present appellant and awarding jail sentence. It is further submitted that it is a case of sudden provocation even if the prosecution story is to be believed. Appellant and deceased consumed liquor together for hours together and when the deceased made some vulgar remarks regarding wife of the appellant, then he got infuriated. However, it was the deceased, who again visited appellant's house purportedly for a motive to get proximity but the same was opposed by the appellant and therefore offence has

allegedly been committed. It is not a case of motive or mens rea to bring home offence under Section 302 of IPC. It may (or may not) be a case of sudden provocation at best if the prosecution story is to be believed. He referred testimony of Jitendra (P.W.2). It is further submitted that appellant has suffered three years and ten months' incarnation as pre and post trial confinement. The appeal is of the year 2024 and there is no likelihood of early hearing of this appeal in the near future. He undertakes to abide by the terms and conditions as imposed by this Court. Appellant voluntarily undertakes to perform community service to purge his misdeed, if any and to serve National/Environmental/Social cause. Under these circumstances, he prayed for grant of suspension of sentence and grant of bail.

4. Per contra, learned Counsel for the State opposes the application and prays for its rejection while supporting the impugned judgment.

5. Heard learned counsel for the parties and record perused.

Considering the submissions as advanced, looking to the period of custody of appellant and nature of evidence subsists against him, but without commenting anything on the merits of the case, application (I.A. No.25311/2024) is allowed subject to deposit of fine amount, if not already deposited and it is ordered that on furnishing a personal bond of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety in the like amount to the satisfaction of the concerned trial Court, jail sentence of appellant shall remain suspended till disposal of this appeal and he be released on bail. He is further directed to remain present before the Registry of this Court on 10.07.2025 and, thereafter, on such subsequent dates as may be fixed

by the Registry.

7. It is made clear that this bail by way of suspension of sentence is granted once the case is made out for bail and thereafter, direction for plantation of saplings is given and it is not the case where a person intends to serve social cause can be given bail without considering the merits.

8. It is expected form the appellant/accused that he shall submit photographs by downloading the mobile application (NISARG App) prepared at the instance of High Court for monitoring the plantation through satellite / Geo- Tagging / Geo fencing etc.

9. Appellant shall not be a source of embarrassment and harassment to the complainant side in any manner

10. A copy of this order be also sent to the trial Court concerned for compliance and information.

11. Certified copy as per rules/directions.
