Heard on I.A.No.4650/2025, which is first application filed under

Section 430(1) of BNSS, 2023 on behalf of the appellant No.2 - Nirbhaysingh Gurjar for grant of temporary suspension of sentence on the ground of marriage of his daughter scheduled on 14.04.2025.

2. Vide judgment dated 27.12.2024 passed by the Learned Session Judge, SC/ST (Prevention of Atrocities) Act, District Rajgarh (Biora) in Special Case No.72/2020, appellant has been convicted for the offence under Sections 147, 148, 302/149 and 307/149 of the Indian Penal Code and sentenced to undergo RI for 1 year, 2 years, life imprisonment, 10 years & Section 3(2)(v) of the SC/ST (Prevention of Atrocities) Act and sentenced to

undergo RI for 10 years with fine and default stipulations.

3. Having regard to the reasons mentioned in the application, I.A.No.4650/2025 is allowed and it is directed that upon furnishing a personal bond in the sum of Rs. 50,000/- with one solvent surety in the like amount to the satisfaction of the Trial Court, the jail sentence of the appellant No.2 Nirbhaysingh shall remain temporarily suspended for a period

2 CRA-330-2025 o f one month. The appellant is directed to surrender before the trial Court immediately after expiry of one month period from the date of his release, failing which the trial Court shall take appropriate steps to take the appellant in custody.
