Prima facie, this revision seems to be arguable. Hence, admitted for final hearing.

Heard on I.A.No.22923/2024, an application under section 438(1) of Bhartiya Suraksha Sanhita, 2023, for suspension of sentence and grant of bail to the applicant pending revision.

The applicant has assailed the judgment of conviction and order of sentence dated 27.08.2024 passed in Criminal Appeal No.43/2023 by Additional Sessions Judge, Patan, Dsitrict Jabalpur (M.P.) arising out of judgment dated 23.08.2023 passed by Judicial Magistrate First Class,

District Patan (M.P.) in Cri.Case No.132/2018 wherein trial Court found the applicant guilty for commission of offence punishable under Section 138 of IPC and sentenced him to S.I. 03 months and has directed to pay Rs.45,000/- with default stipulations. The learned appellate Court has affirmed the judgment of conviction and order of sentence passed by the trial Court. Considering the short nature of the sentence and the fact that the appellant

2 CRR-4490-2024 has already suffered one month incarceration, bail application is allowed. It is directed that upon depositing of Rs.15,000/- before the trial Court and on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one solvent surety in the like amount to the satisfaction of the trial Court for his appearance before the trial Court on 16.12.2024 and on all subsequent dates as may be fixed by the trial Court in that regard, he be released till further orders.
