Perusal of the record would indicate that the petition under Section 13 of the Hindu Marriage Act filed by the respondent/husband was decreed vide judgement and decree dated 13.10.2022. The memo of cost attached with the
decree was prepared on 18.10.2022. The certified copy of the judgment and decree was supplied on 20.10.2022. The appeal was filed in the High Court on 14.11.2022. There is a pointed allegation against the respondent that the respondent has solemnized second marriage even within the limitation for filing appeal by the appellant.
Learned counsel for the respondent/husband very candidly submits that his client has specifically told him that he has solemnized marriage only after expiry of period of limitation for filing appeal by the appellant.
Let an affidavit of the respondent be filed in the context of re-marrying
with reference to the specific date and event for performing the marriage. The name of the second wife be also disclosed in the affidavit along with her particulars.
Both the parties are also directed to remain present in the court on the next date of hearing.
List this case on 03.07.2024.
