Heard on I.A. No.28002 of 2023, an application under
Section 398(1) of the Cr.P.C. moved on behalf of appellant
no.1/applicant for suspension of sentence.
By the impugned judgment of sentence and order of
conviction, appellant has been convicted for offence under Section
306/34 of IPC and sentenced to undergo RI for 05 years with fine of
Rs.1,000/- with default stipulation.
It is the submission of learned counsel for the appellant that
trial Court erred in convicting the appellant and awarding the jail
sentence. He has already suffered around 10 months of
incarceration as post and pre trial incarceration. It is further
submitted that prosecution could not prove beyond reasonable
doubt about the goading or abetment caused by appellant to his
deceased wife, who committed suicide after 15 years of marriage.
He refers the testimony of Dushyant Jhariya (DW-1) to bring home
the fact that appellant never ill-treated his wife and his wife was
mentally unstable and, therefore, she committed suicide out of pain and
agony she underwent because of her mental problem. It is not the case
of abetment per se. Hearing of appeal shall take time and fine amount
has already been deposited. He further undertakes to perform
community service to purge his misdeeds if any and to save
National/Environmental/Social Cause. Under these grounds, counsel
prays for bail/ suspension of sentence. On these grounds, prayer for
suspension of sentence has been made.
Learned counsel for respondent/State opposed the prayer and
prayed for dismissal of application.
Keeping in view the submissions made by the learned counsel
for the parties and looking to the facts and circumstances of the case,
subject to deposit of fine amount, I.A. No.28002 of 2023 is allowed.
It is directed that jail sentence of appellant shall remain
suspended subject to appellant's furnishing a personal bond in the sum
of Rs.50,000/- (Rupees Fifty Thousand Only) by appellant with one
solvent surety of the like amount to the satisfaction of the concerned
trial Court, appellant's jail sentence shall remain suspended till disposal
of this appeal and he be released on bail. The appellant is further
directed to remain present before the concerned trial Court on
14/10/2024 and, thereafter, on such subsequent dates as may be fixed
in this regard by the trial Court.
This order will remain operative subject to compliance of the
following conditions by the applicant:-
(i) The applicant shall not involve in any criminal activity in
future and would participate in creative pursuits.
(viii) It is made clear that this bail is granted once the case is made
out for bail and thereafter, direction for plantation of saplings is
given and it is not the case where a person intends to serve social
cause can be given bail without considering the merits.

It is expected from the applicant that he shall submit
photographs by downloading the mobile application (NISARG
App) prepared at the instance of High Court for monitoring the
plantation through satellite/Geo-tagging/Geo-fencing.
Application stands allowed and disposed of.
A copy of this order be sent to the trial Court concerned for
compliance and information.
