                                At the outset, learned counsel for the appellant submits that the trial Court
                          decreed the suit of the plaintiff and learned First Appellate Court allowed the

                          appeal and dismissed the suit.
                                The appeal is admitted on the following substantial question of law :-
                                    " Whether learned lower appellate Court was right while setting
                                    aside the judgment and decree passed by trial Court and by not
                                    appreciating the importance of Section 34 of Specific Relief Act
                                    ?"

                                On payment of P.F. within 7 working days, issue notice to the
                          respondent/defendant.
