Heard on I.A. No.7690/2023, which is an application under Section 389(1) CrPC for suspension of sentence and grant of bail on behalf of the appellant No.1, who has been convicted and sentenced by the impugned

judgment under Section 394 IPC to undergo R.I. for 7 years and find of Rs.5000/- with default stipulation.

Having considered the arguments advanced on behalf of the parties, perusal of the records and character of evidence and criminal antecedents of the appellant, no case is made out for suspension of sentence and grant of bail to the appellant No.1.

Accordingly, the present I.A. No.7690/2023 stands rejected. Also heard on I.A. No.1146/2023, which is an application under Section 389(1) CrPC moved on behalf of the appellant No.2.

After arguing for a while, learned counsel prays for withdrawal of this application.

Accordingly, the I.A. No.1146/2023 stands dismissed as withdrawn. List the case in due course along with Criminal Appeal No.11482/2022.
