At the outset, learned counsel for the appellants submits that appellants/ defendants have lost in both the Courts below but the trial Court as well as the First Appellate Court failed to appreciate the facts, pleadings and evidence in

right perspective. In fact they gave wrong judgment on Wills dated 27.4.1989 (Ex. D/5) and 31.08.1994 (Ex. D/4). He further submits that both the Courts ignored the affidavits Ex. D/2, D/3, D/7, D/8 and also gave wrong finding whether the suit was time barred or not, therefore, arguments on admission were heard.
