It is submitted by counsel for the applicants that because of non-
availability of their counsel, complainant could not be cross-examined and
therefore, right of the applicants has been closed. It is submitted that in case if
the complainant is not permitted to be cross-examined, then the applicants
would suffer irreparable loss. A last opportunity may be granted to the
applicants on payment of cost of Rs.10,000/-.
Issue notice to the respondent on payment of process fee by registered
AD mode, payable within three working days.
Notices are made returnable within a period of three weeks. List on 12/03/2024.
As an interim measure, it is directed that the Trial Court may proceed further but no final judgment shall be delivered.
