Learned senior counsel with reference to the objection raised by the
learned counsel for the respondent in respect of maintainability of petition under Section 482 of Cr.P.C., submits that the view expressed by the learned Single Judge is Per-incuriam in view of Full Bench judgment of Bombay High Court and also the order passed by the Co-ordinate Bench at Indore. However, the learned senior counsel for the petitioner seeks time to file an appropriate application with the liberty to press his contention that the petition under Section 482 of Cr.P.C is also maintainable.
Interim relief, if any, granted earlier shall continue till the next date of hearing.
