Heard on I.A.No.9992 of 2024 - an application for recalling of the order dated 08.05.2024.

It is pointed out that the petition was disposed off with bunch of other

petitions in the light of the judgment passed by the Full Bench of this Court in the case of State of M.P. and others Vs. Jagdish Prasad Dubey (Writ Appeal No.815 of 2017) decided on 06.03.2024. It is argued that the recovery from the petitioner is to be made in pursuance to the punishment order passed after the departmental enquiry, therefore, the same would not be covered in terms of the judgment passed by the Full Bench in the case of Jagdish Prasad Dubey (supra).

In terms of the aforesaid, the order dated 08.05.2024 passed in Writ Petition No.17630 of 2020 is hereby recalled.

This writ petition is restored to its original number. Accordingly, the application (I.A.No.9992 of 2024) stands disposed off.
