ORDER
The present petition under section 482 of Cr.P.C. has been filed for
quashment of FIR dated 16.04.2024 registered vide Crime No.285/2024 at
Police Station Karera District Shivpuri for the offence under section 363 of
IPC as well as further criminal proceeding.
2. Short facts of the case are that the complaint Deepak Gupta
informed to the police that on 16.04.2024 at 07:00 AM morning his daughter
aged about 17 year has gone to Poornank coaching for study but she did not
return back so he visited Poornak Coaching and found it to be closed. He,
therefore, doubted that Shiv Kothari might have taken his daughter. On this
complaint, the police lodged the FIR at crime no285/2024 under section 363
of IPC against the present petitioner.
3. Learned counsel for the petitioner had argued that the petitioner was

minor at the time of incident so he cannot be implicated for the offence under
Section 363 of IPC, as the minor petitioner has nothing to do with the said
offence directly and indirectly, therefore, registration of F.I.R. against the
minor petitioner is nothing but a colorable exercise of power and the
investigation agency is looking into the matter with the colored Glasses just
for harassment and nothing else, therefore impugned F.I.R. Annexure A-1
dated 16.04.2024 as well as subsequent criminal proceeding is liable to be
set-aside.
4. To bolster his submissions, learned counsel placed reliance in the
matter of Haryana & Ors Vs. Ch. Bhajan Lal & Ors, (1992) SCC (Cri) 426
and in the matter of S.Varadarajan Vs. State of Madras reported in AIR 1965
SC 942, wherein the Hon'ble Apex Court had come to a conclusion that if the
accused played some role at any stage by which he either solicited or
persuaded the minor to abandon the legal guardianship, it would be sufficient
to hold such person guilty of kidnapping and when it was the minor
prosecutrix who herself had walked out of the house and had left the
company of her legal guardian without any inducement from the accused,
hence, in the light of ab above judgment of Supreme Court, no offence under
Section 363 of IPC can be said to be established against the petitioner,
therefore, he is entitled for acquittal.
5. Thus, it was submitted that the present petition deserves to be
allowed and the petitioner be acquitted from the charges and the FIR dated
16.04.2024 registered vide Crime No.285/2024 at Police Station Karera
District Shivpuri for the offence under section 363 of IPC be quashed.

6. Per contra, learned Govt. Advocate for the State submits that from
bare perusal of the contents of the FIR prima facie the offence under the
section mentioned therein are made out against the present petitioner, and
therefore, the prayer made by the counsel for the petitioner for quashing the
FIR should not be acceded to. Thus, it was prayed that present petition be
dismissed.
7. Heard the counsel for the parties and perused the record.
8. From bare perusal of the FIR as well as the statement of the
prosecutrix recorded under Section 161 of Cr.P.C., no case of Section 363 is
made out. For reference FIR and Statements under Section 161 of Cr.P.C. are

जाकर देे खा तो तो पूणाक कोिचंग बंद हो चुक थी। मुझे करै रा के िशव
कोठार पर शंका है क मेर लड़क आ था को बहला फुसलाकर ले गया
है । मेर लड़क का हुिलया रं ग गोरा, कद कर ब ४.६ इं च, मह न कलर का
टोप व नीले कलर का जींश पहने है । सो रपोट करता हू ँ कायवाह क
जाव।

मुझसे एक छोटा भाई ऋ ष गु ा उ १४ वष का है मने अभी क ा ११वी
के पेपर दये ह म िशव कोठार को लगभग एक साल से जानती हू ं िशव
कोठार तथा एक ह कोिचंग पर साथ म पढ़ते थे हम अ छे दो त ह
दनांक १५.०४.२०२४ को मेर तथा िशव क मोबाईल पर घूमने जाने क
बात हो गयी थी इसिलए दनां◌ंक १६.०४.२०२४ को म तथा िशव
कोठार घर से कोिचं◌ंग जाने क बेालकर िनकले थे म अपने घर से
कर ब ५००० पये तथा िशव अपने घर से २०-५० हजार पये लेकर
आया था हम लोग अपने अपने मोबााईल घर पर छोड़कर आये थे, हम
दोनो करै रा से सुबह कर बन ७ बजे िशव क मोटरसाई कल से झांसी
पहुच
ं े झांसी म हमने रा ते म गली म मोटरसाई कल रख द थी फर हम
बस म बैठकर वािलयर पहूच
ं े, वािलयर म रे वे टे शन पर द ली जाने
वाली वाली े न का इं तजार कया, फर हम अगले दन द ली पहुच
ं गये

थे फर हम १०-१२ दन द ली म घूमे फरे और अपने साथ लाये पये से
खाना पीना और खचा चलाया, हम दोन द ली म रे वे टे शन के बे टं ग
मम कते थे यू ं क हमारे पास आधार काड नह थे और हमार उ
कम होने से कोई हम होटल म कमरा नह ं दे ता इस कारण हम लोग रे वे
टे शन के बे टं ग म म कते थे वहां और भी लोग होते थेे, द ली म
हमने ALLIN कोिचंग दे खी थी, द ली मे हम लोटस टे पल, कुतुब
मीनार, टे लोई ट पाक, लाल कला, इं डया गेट और भी जगह घूमे थे,
फर हम कोिचंग दे खने के िलए द ली से े न से केाटा पहूच
ं े कोटा म
हमने दो तीन कोिचंग दे खी और आज दनांक ०२.०५.२०२४ के सुबह ०६
बजे कर बन रे वे टे शन के पास होटल के पास चाय पीने गये थे तभी
पुिलस आ गयी और मुझे तथा िशव को अपने साथ थाना करै रा लेकर आ
गयी, पुिलस के साथ िशव के पापा जी भी थे, मेरे तथा िशव के माता पता
हमे बाहर घुमाने के िलए नह ले जाते थे इस कारण हम दोनो ने घर पर
बना बताए एक साथ घूमने चले गये थे, म अपनी मज से घूमने गयी थी
मुझे कोई बहलाफुसलाकर नह ले गया और नह मेरे साथ कोई घटना
हुयी है न ह िशव ने मेेरे साथ कोई गलत काम कया है , यह मेरा बयान
है ।

नोट- ाथ ारा वे छया बना कसी भय, दबाव या लालच के
कथन करना य कया।
१ . मने क ा ११ वीं के पेपर दये ह। हम दो भाई बहन ह। मुझसे

एक छोटा भाई है जो भी पढ़ाई करता है । म िशव कोठार को लगभग एक
साल से जानती हू।ँ िशव कोठार और म एक ह कोिचंग म लगभग एक
साल से पढ़ रहे ह। िशव कोठार मेरा ◌ंड ह। दनांक १५.०४.२०२४ को
मने िशव कोठार को फोन लगाकर बेाला था क म द ली घूमना चाहती
हू◌
ँ ँ तुम मेरे साथ द ली घूमने चल रहे हो या तो िशव कोठार ने कहा
क हां ठ क है म तु हारे साथ चलूग
ं ा। फर हम लोग क लािनंग हुयी
क कैसे चलगे और कब चलगे िशव कोठार ने कहा क मेरे पास बीस
प चीस हजार पये ह और अपन बाईक से झांसी तक चलगे झांसी म
बााईक रखकर झांसी से वािलयर तक बस से चलेगे और िशव कोठार ने
कहा क कल तुम अपने घर से थोड़ दरू पर क ची गली म सुबह सात
बजे आ जाना म भी आ जाउं गा। इसके बाद दनांक १६.०४.२०२४ को म
सुबह घर म अपनी म मी को कोिचंग जाने का बेेालकर चली गयी थी।
मुझे िशव कोठार मेरे घर से कर ब ४०० ५०० मीटर दरू पर खड़ा िमला
इसके बाद म िशव कोठार के साथ मोटरसाई कल से झांसी बस टे ड
पहुच
ं ी । िशव कोठार ने झांसी बस टै ड के आगे एक गली म अपनी
मोटरसाई कल को रख दया और म और िशव कोठार झांसी बस टै ड
से वािलयर वाली बस म◌ं बैठकर वािलयर बस टै ड लगभग दन के
दो तीन बजे पहुच
ं े और वहां पहुच
ं कर हम दोन वह ं थोड़ दे र के िलए घूमे
और टै सी म बैठकर हम दोन वािलयर रे वे टे शन पर पहुच
ं े और िशव
कोठार ने अपना और मेरा जनरल का टकट कटवाया इसके बाद म और
िशव कोठार कर ब शाम सात बजे द ली वाली े न म बैठ गये और
अगले दन दनांक १७.०४.२०२४ को द ली पहुच
ं गये और द ली म
रे वे टे शन पर मने और िशव कोठार ने खाना खाया। िशव कोठार ने
द ली म ह होटल म कमरा र◌ंट से लेने के जानकार ली, परं तु मेरे पास

और िशव कोठार के पास आधार काड नह थे और मेर और िशव कोठार
क उ कम होने से हम होटल मे कमरा नह िमला इस कारण म और
िशव कोठार द ली म लगभग दस बारह दन रे वे टे शन के वे टं ग म
म रहे वहां पर और भी लेाग के हुये थे। द ली म हमने पढ़ाई के िलए
एलाईन कोिचंग दे खी। द ली म म◌ं और िशव कोठार लोटस टपल,
कुतुब मीनार, इं डया गेट, लाल कला, टे लोई ट पाक और भी जगह
घूमे थे। दनांक २९.०४.२०२४ को रात एक बजे क े न म म और िशव
कोठार बैठकर द ली से कोटा के िलए चले गये थे अगले दन दनांक
३०.०४.२०२४ को हमने कोटा म द तीन कोिचंग दे खी और कर ब दोपहर
दो बजे रे वे टे शन के पास होटल म खाना खाया तभी वहां पर पुिलस आ
गयी और मुझे और िशव कोठार को थाना करै रा ले आई थोड़ दे र बाद
म मी पापा और िशव कोठार के म मी पापा थाना करै रा आ गये थे। मेरे
पता ने थाना करै रा म मेर गुमशुदगी क रपोट िलखायी थी। य द म
िशव कोठार के साथ अपनी घूमने जाने वाली बात बताती तो मेरे म मी
पापा मुझे िशव कोठार के साथ घूमने नह ं जाने दे ते। म िशव कोठार के
साथ अपनी मज से द ली घूमने गयी थी मेरे साथ कोई गलत काम नह ं
हुआ है ।
9. In the event of provisions of said section having been not attracted
so far as the present petitioner is concerned his involvement in the offence
cannot be said to be made out.
10. Thus, on account of non-attraction of the provisions under which
the FIR has been registered. Thus, the present FIR does not with stand the
judicial scrutiny.
11. Accordingly, the FIR dated 16.04.2024 registered vide Crime

No.285/2024 at Police Station Karera District Shivpuri for the offence under
section 363 of IPC is hereby quashed so far as it relates to the present
petitioner.
12. With the aforesaid, the petition is allowed and disposed of
